NEW REGULATIONS FOR LEGALIZING THE STAY OF FOREIGNERS IN POLAND.

At its meeting on October 19, 2021, the Council of Ministers adopted a draft amendment to the Law on Foreigners, which is expected to facilitate and speed up the procedure for legalizing the stay of foreigners in Poland. This primarily concerns combined residence and work permits, because foreigners arriving in Poland most often apply for this type of permit. The new regulations provide for the abandonment of the requirement to have an assured place of residence and the requirement to have a source of stable and regular income for the granting of a temporary residence and work permit. Instead, another requirement has been introduced – a person applying for legalization of residence must receive a salary for work that is not less than the national minimum, regardless of the type of contract he has signed with his employer. The bill also introduces a new procedure for amending the temporary residence and work permit in the situation of a change in the entity entrusting work or in the conditions of exemption from the work permit requirement, as well as amendments on the issuance of a seasonal work permit. In addition, changes will apply to declarations of entrustment of work to a foreigner by extending the period of permissible work on a single declaration to 24 months, and it has been proposed to allow acceleration of the issuance of a work permit for foreigners intending to perform work in entities of special strategic importance for the Polish economy. The procedure for applying for a Pole’s Card will be facilitated.
